2. Purpose of this manual

This manual helps members of the public understand what records The 2Wheelers Den (Pty) Ltd holds, and how to ask for access to them. It explains:

  • the categories of records we hold that are available without a formal request;
  • how to request access to a record, and the prescribed forms and fees;
  • records that may be available under other legislation;
  • how to contact our Information Officer;
  • how to get the Information Regulator’s Guide on how to use PAIA; and
  • how we process personal information, in line with POPIA.

4. Guide on how to use PAIA

The Information Regulator has compiled an official Guide on how to use PAIA. It explains the objects of PAIA and POPIA, how to request records from public and private bodies, the assistance available from Information Officers and the Regulator, the remedies available, and the fees and forms that apply.

The Guide is available from the Regulator at inforegulator.org.za/paia, in English and other official languages, and can be inspected at the Regulator’s offices. 8. Processing of personal information

8.1 Purpose of processing. We process personal information to respond to enquiries, sell products and pre-owned motorcycles, arrange and carry out workshop services, keep business records, meet legal obligations, and deal with complaints or disputes. See our Privacy Notice for more detail.

8.3 Recipients of personal information.

8.4 Transborder flows. We do not send personal information outside South Africa ourselves. Some of the service providers we use, such as Google and Meta (WhatsApp), may store or process information outside South Africa under their own terms.

8.5 Information security measures. We take reasonable technical and organisational measures to protect the confidentiality, integrity and availability of personal information, including limiting access to those who need it.

9. How to request access to a record

  • Complete Form 2 (Request for Access to Record), available from the Regulator at inforegulator.org.za/paia, or ask us for a copy.
  • Send it to our Information Officer at the email address or physical address in section 3. Give enough detail to identify the record, say which form of access you want, and, for a private body, state the right you wish to exercise or protect and why the record is needed for that.
  • If you are asking on behalf of someone else, attach proof of your authority. If you cannot complete the form because of illiteracy or disability, you may make the request orally, and we will complete the form for you.
  • We will decide on your request within 30 days of receiving it. This may be extended once by up to 30 days in the circumstances PAIA allows, and we will tell you if so.
  • If your request is granted, we will tell you the access fee, if any, and how access will be given. If it is refused, we will give reasons, including the provisions of PAIA relied on.
  • A request may be refused on the grounds set out in PAIA, for example to protect the privacy of another person, commercial confidentiality, or legal privilege.

10. Fees

Fees are set by the PAIA regulations. The amounts below are the Information Regulator’s published fees at the date of this manual and may change; the current schedule on the Regulator’s website applies. A requester who is asking for records about themselves (a personal requester) pays only the reproduction fee.

11. Remedies if a request is refused

If you are unhappy with our decision, or we do not respond in time, you may lodge a complaint with the Information Regulator using Form 5 within the period PAIA allows (currently 180 days), or apply to a court with jurisdiction. Forms and contact details are at inforegulator.org.za/paia.
